PERSONAL DATA PROTECTION INFORMATION TEXT FOR SUBCONTRACTOR EMPLOYEES
Data Controller Identity
As the data controller, we, İmer-L&T İş Makinaları Anonim Şirketi (the “Company”), registered with the Aksaray Trade Registry Office under number 6038 and operating at Erenler OSB Mah. 13. Sokak. İmer Apt. No: 23 Merkez, Aksaray, are hereby notified of the following matters within the scope of our obligation to inform you in order to ensure our compliance with Personal Data Protection Law No. 6698 (“Law”) regarding the personal data we obtain from subcontractor employees.
For What Purposes Will Personal Data Be Processed?
Your general and specific personal data, consisting of your identity data, contact data, financial data, visual/audio data, signature data, and health data, are processed by the Company in accordance with the basic principles stipulated in the Law. Because you are a subcontractor, the Company processes your general and specific personal data for the following purposes:
Conducting financial processes, including offers, orders, and payments, with companies with which we have business relationships, ensuring internal company controls,
Providing internal communication activities, and
Conducting field security processes within the scope of physical space security and occupational health and safety within the Company.
Furthermore, your aforementioned personal data may be transferred to the Company’s physical archives and information systems, including domestically-based ERP applications, email servers, and camera recording devices located in Finland, and stored both digitally and physically.
To Whom and for What Purposes May Processed Personal Data Be Transferred
To fulfill the purposes described in Article 2 of this Disclosure Statement, your collected personal data may be transferred to:
The Company’s ERP system service provider due to its use of the ERP system;
The Company’s email account provider in Finland for the creation of your company email account;
The occupational health and safety company with which we collaborate to ensure on-site security within the scope of occupational health and safety;
to relevant companies for the execution of financial processes, including offers, orders, and payments, and for the maintenance of internal company controls;
and to the relevant Regional Gendarmerie Command for the maintenance of physical premises security.
Method and Legal Basis for Collecting Personal Data
Your personal data may be collected by or through the Company, whether automatically or non-automatically. Data may be processed for the purposes specified in Articles 2 and 3 of this Information Notice, for the legal reasons specified in Articles 5 and 6 of the Law, including the establishment or performance of a contract, the legitimate interests of the data controller, and the legal obligations of the data controller.
Your personal data is collected by the Company from information submitted to you verbally, physically, and electronically in writing, through applications and software used within the scope of the Company’s activities.
Rights of the Personal Data Owner
Pursuant to Article 11 of the Law, prospective employees whose personal data has been processed may contact the Company and make requests regarding the following:
To learn whether their personal data has been processed;
To request information regarding the processing of their personal data if it has been processed;
To learn the purpose of processing their personal data and whether it is being used by us in accordance with these purposes;
To learn the third parties to whom their personal data has been transferred, domestically or internationally;
To request correction of their personal data if it is incomplete or inaccurate; To request the deletion, destruction, or anonymization of personal data if the reasons requiring its processing no longer exist;
To request notification of these data to third parties to whom data is transferred in such cases or in the event of correction;
To object if you believe that a detrimental result has been produced by the analysis of processed data exclusively through automated systems;
To request compensation for any damages incurred due to unlawful processing.
