Data Controller Identity

As the data controller, we, İmer-L&T İş Makinaları Anonim Şirketi (the “Company”), registered with the Aksaray Trade Registry Office under number 6038 and operating at Erenler OSB Mah. 13. Sokak. İmer Apt. No: 23, Merkez, Aksaray, are hereby informed of the following matters within the scope of our obligation to inform you in order to ensure that we act in compliance with Law No. 6698 on the Protection of Personal Data (“Law”) with respect to the personal data we obtain from our customers.

For What Purposes Will Personal Data Be Processed?

Your personal data, consisting of your identity data, contact data, financial data, signature data, visual/audio data, and vehicle data, is processed by the Company in accordance with the basic principles stipulated in the Law. Because you are a Company customer, the Company processes:

to conduct relevant financial processes, including offers, orders, and payments, and to ensure internal controls;
to manage processes related to magazines, catalogs, and social media accounts to increase product awareness;
to conduct field security processes within the scope of the Company’s physical location security and occupational health and safety;
to manage post-sale product malfunction processes;
to manage product logistics processes;
to carry out assembly and post-assembly delivery processes performed at the Company; and
to carry out project and licensing processes related to the Company’s products and services.

In accordance with the personal data processing conditions and purposes specified in the Law and other relevant legislation.

In addition, your personal data mentioned above may be stored both digitally and physically in the Company’s physical archives, as well as in information systems including websites, social media account providers, ERP applications, email servers and camera recording devices located in Finland, and in the systems of magazine and catalog companies. To Whom and for What Purposes May Processed Personal Data Be Transferred

Your collected personal data will be shared with the following parties in order to fulfill the purposes described in Article 2 of this Disclosure Statement:

To the ERP system service provider due to the Company’s use of the ERP system;
To the occupational health and safety company with which we collaborate to ensure field safety within the scope of occupational health and safety;
To the email account provider in Finland for the purpose of managing email system processes through email correspondence with the Company;
To the relevant Regional Gendarmerie Command for the purpose of managing physical location security;
To relevant social media providers (such as YouTube and LinkedIn) and third parties that may view related magazine and catalogue posts to increase product awareness;
To third-party business partners for the management of product assembly and logistics processes;
To the Turkish Standards Institute and TÜV Türk for the purpose of licensing processes;
To the cargo company for the purpose of creating and tracking cargo shipments. The Company may be transferred to the Company.

Method and Legal Basis for Collecting Personal Data

Your personal data may be processed and transferred by or through the Company, by automatic or non-automatic means, for the purposes specified in Articles 2 and 3 of this Disclosure Statement, for the legal reasons specified in Articles 5 and 6 of the Law, for the establishment or performance of a contract, and for the legitimate interests of the data controller.

Your personal data is collected by the Company from information submitted verbally, physically, and electronically in writing, through applications and software used within the scope of the Company’s activities.

Rights of the Personal Data Owner

Pursuant to Article 11 of the Law, customers whose personal data is processed may contact the Company and make requests regarding the following:

To learn whether their personal data is being processed;
To request information if their personal data has been processed;
To learn the purpose of their personal data being processed and whether we are using it in accordance with these purposes;
To learn about the third parties to whom personal data has been transferred, whether domestically or internationally;
To request correction of personal data if it has been processed incompletely or incorrectly;
To request the deletion, destruction, or anonymization of personal data if the reasons requiring processing no longer exist;
To request notification of these or any corrections to third parties to whom data has been transferred;
To object if the data has been analyzed exclusively through automated systems, if the data has resulted in a detrimental outcome;
To request compensation for any damages incurred due to processing in violation of the law.

Your rights listed above

You can submit your requests to the Company using one of the following channels by completing the “Personal Data Owner Application Form,” which you can access at www.imer-lt.com.tr:

By submitting your application in person to Erenler OSB Mah. 13. Sok. Imer Apt. No: 23 Merkez, Aksaray, after verifying your identity;

By sending your application to the Company’s email address, ik@imer-lt.com.tr, via your registered email address (KEP), or by using a secure electronic signature, mobile signature, or the email address previously notified to the data controller by the relevant person and registered in the data controller’s system; or
through software or an application developed specifically for the purpose of the application.

Your applications will be finalized free of charge, in accordance with Article 13 of the Law, depending on the nature of your request, as soon as possible and within thirty days at the latest. However, if your application will be responded to in writing, a processing fee of 1 Turkish Lira may be charged for each page exceeding ten pages, in accordance with Article 7 of the Communiqué on the Procedures and Principles of Application to the Data Controller.
